If Legislation Fails Who is There to Follow?

Judge Richard C Wesley, who had worked in the Legislature of New York, and subsequently, in its High Court, gave a speech in the Albany Law School, where in he discussed the technique of appellate judging in Common Law Courts. The second such exposition was at a seminar on the use of legislative history in interpreting New York State and Federal Statue, at the same venue. The discussion dealt with law making and the history of the legislature of this state. In respect of Article III of the Constitution, he stated that Congress had limited the powers conferred by the constitution in respect of resolution of cases. With regard to judicial verdicts, he discussed the statutory interpretation in respect of several cases which had a bearing on the future of the State as well as the Courts. Further, he expressed his discontent in respect of the process of Judicial Review, which results in the failure of the Court in framing an opinion. In this context he cited the case of Majewski v Broadalbin – Perth Control School District. The issues discussed were whether the changes in the workers’ compensation law restricting third party tort-fea ·sor seeking contribution from an injured employee’s employer were prospective or retroactive. Though the statute did not provide a clear answer, the Bill’s sponsor in the assembly proclaimed that it was prospective, while the Governor announced at the Bill’s signing that there would be an appreciable reduction in the insurance premia being paid by employers. Based on this outcome, he opined that judges will have to decide what was intended by such legislation. In his opinion, Judicial Activism has been limited to querying the Congress to explain the meaning of the various statutes. In this connection, there are occasions where regulatory or legislative schemes come under scrutiny and come up short under Constitutional Analysis. Judges have to follow the Federal Sentencing Guidelines. The Supreme Court has heard two cases, U.S.V Baker and U.S.V Fanfan, which more or less signals the end of the sentencing schemes under the Constitution. According to him, the will of Congress does not trump the Constitution. This results in Congress forsaking the guidelines as a discretionary sentencing guide and leaving the task to even up the range of sentences to a law based arbitraryness review. In another case, Campaign for Fiscal Equity V New York, the Constitutionality and Federalism of the State were challenged. In 1995, the Court had ruled that the plaintiff’s complaint did plead a cause of action on State Constitutional Grounds. The Constitutional Standard for that Mandate was that the State must provide a sound basic education to all New York Children. The outcome of this case was that the School funding is based on political expediency and not on educational necessity. According to him the Court had transposed the Constitutional Provision from a general commitment to public education into substantive policy – laden guarantee of educational proficiency that would ultimately drag the Courts into a resource allocation fight with the Legislature. Absence of a Legislative Response to a Judicial Decree, declaring the Constitutional shortcomings of a state education system, the Courts have to manage the State’s Education Funding System; this is a job, which the majority of the fiscal equity noted that the Court had neither the authority, the ability nor the will to do. Richard C Wesley expressed his view that the quasi – legislative/ executive role will strain the Courts’ own intellectual and institutional resources, while providing the Executive with an excuse to usurp the Courts’ Powers. He further, contended that Governing and Judging are two dissimilar things and that the public policy is best formulated by means of public debates. Though the Judiciary has been granted an independent existence by the Constitution, in reality the Legislature controls it. Since Legislature is the most powerful wing of the U.S.Government, according to Wesley if it fails, there is no further recourse. The foregoing discussion illustrates the penchant of the legislature to interfere with the functioning of the judiciary. Whenever, the legislature fails to resolve any problem, the judiciary steps in to rectify the same. However, with the legislature making all out efforts to subjugate the judiciary, there is nothing which can retrieve the situation once the legislation fails (Wesley, n.d). References. Wesley, Richard C. (n.d.). If Legislatures Fail, Who is there to Follow?

The Social Side of Decision Making Essay Example | Topics and Well Written Essays - 500 words

The Social Side of Decision Making - Essay Example Analyzing Bennett's response, the reason why I agreed to his analysis was because I applied my answer based on the events that happened to be the circumstances of the case. Looking at the man's profit as a result of continuous instead of isolated and deterministic events, my line of reasoning would indeed be similar to Bennett's. That the man earned $10 because, after all the transactions he engaged in, he ended up with a profit of $10. However, taking into account Amy's response on the problem, it surfaced that logically, and within the business context, the man ended up earning $20, for the two determined transactions stated in the case. Thus, the difference between Bennett's and Amy's response was the context in which both members analyzed the problem. Bennett considered the man's transactions as a continuous process, hence producing a profit of $10. Amy, on the other hand, applied the case in terms of isolating each transaction conducted by the man, hence coming up with the $20 a nswer. An important principle shown in the activity is the application of the right context in a problem in order to come up with the right or correct answer.

That's news to me Essay Example | Topics and Well Written Essays - 750 words

That's news to me - Essay Example Sometimes, it feels weird to be a part of some platform where anybody can share anything any time which can be approved of or disapproved of by anybody. One way technology influences how I receive information is that news is no more credible to me than theories because both can be right or wrong. One way technology influences how I send information is that it makes me be a critic of my own work before sharing because I am aware that people in the online world know me by what I share. Modern technology has changed my perception of news broadcast over the mainstream media. Before, when I was a child, and the world was not quite as influenced by the Internet as it happens to be today, I used to believe everything shown or talked about in the television news. As I grew up, used the internet, and started to realize through blog posts and online discussion forms that news are selected and modified by various television channels in such a way that their personal interests are served, the cr edibility and reliability of information retrieved from the mainstream media news has been reduced for me. ... ortant, and I have no doubt in it because even I use the Internet to get news more than I use the television, then I believe that all sorts of news are very subjective. Modern technology has made me more critical about what I share with the world. In the real or physical world, I do a lot of jokes and casual talking with people because I know that the people I talk to know me otherwise. Even if I am saying stupid jokes, I am confident that my friends would accept them because they know what sort of a person I am. On the other hand, when I am using the Internet to share any information, be that my status on social networking website, or a photo I have recently taken of myself, I take my time to think whether it is the right status or photo to share. This is because I understand and agree to the fact that â€Å"as digital media continues to evolve, it will be today’s youth who’ll reshape the future content and delivering of news and information† (Garland cited in L ancaster). Many a times, I select some people from my friends’ list to deter my status or photo to be shared with them because of personal reasons or my lack of trust in those friends. I am not so conscious and critical in what I express or share in my everyday life otherwise. Concluding, Internet has had a profound effect in my approach toward receiving and sharing information. Under this effect, I have lost confidence in news but have become more critical about what I share with the world. I cannot control others but I can control myself. So I tend to be very responsible, considerate, and rational while commenting upon a post or a video or even while writing and sharing a blog over the Internet. I want to be a source of help and good guidance for others, which is what makes me criticize my own work that

FEDEX REPORT Essay Example | Topics and Well Written Essays - 1250 words

FEDEX REPORT - Essay Example As far as product and market destinations are concerned, FedEx is known to offer the second largest civil fleet service across the United States and other Caribbean Islands including Puerto Rico and Dominican Republic (Breiman et al, 2009). There also is FedEx Ground, which is a dedicated courier service for Canada and other North American countries. FedEx also offers customer specification and tailor services including home delivery, custom and insurance provided through FedEx Trade Network, supply chain service, corporate services, print service, as well as FedEx Ship Centers. As a way of ensuring that its products meet customer specification and needs, there is a dedicated FedEx product named FedEx TechConnect, which offers toll free customer support to customers all around the globe. It has been said that through FedEx TechConect, FedEx creates a competitive advantage of learning from within its own rank, why and how it will succeed with its product strategy. Pricing Strategies P ricing has been said to be a very important marketing strategy for the creation of competitive advantage in a globally competing market. ... The price discount on FedEx Ground is one of such popular pricing strategies used by the company to ensure that customers get value for money. What is more, FedEx tries to keep its traditional base cost of service as minimal as possible. For example pick up services are offered by FedEx at a traditional rate of $6 per delivery (Carter, Daniel and Betty, 2006). In relation to key competitors on the American and Canadian market, this traditional cost has been said to be one of the lowest. In addition to the traditional cost offered on pick up services, there is an additional weekly charge of $6 for business locations that make requested pick up services. Placement Strategies In terms of location, FedEx is predominately situated in the United States and Canada. These are where most of its stationery offices are. But thanks to globalization and flight services, this limited placement is not in any way a limitation to the distribution strategy adapted by the company. This is because in it s scheme of distribution strategy, the company operates on a borderless strategy whereby it opens up its service to all continents of the world. To make this strategy sustainable, FedEx has an air fleet service dedicated for an inter-continental goods and mail delivery. Even though the company reports of effectiveness with this distribution strategy, experts have said that FedEx could reach a more deepened mileage with its products and services if the company expanded its placement by way of opening more offices and centers across its key regional markets (Icove, Karl and Vonstorch, 2005). It has been suggested for example that the company had continental head quarters, from which it would operate a more decentralized placement strategy. The advantage of such a decentralized placement

Miss Brill Essay Example | Topics and Well Written Essays - 500 words

Miss Brill - Essay Example Both the young boy and his girl-friend express their emotions; the boy refers to Miss Brill, as â€Å"the stupid old thing,† stating further, "Why does she come here at all—who wants her? Why doesnt she keep her silly old mug at home?" (Mansfield 857). The plot of the story provides meaning to the theme of loneliness, starting from Miss Brill â€Å"decided on her fur†¦Dear little thing! It was nice to feel†¦Ã¢â‚¬ Relatively, there were more people than the previous Sunday. She shares her talk to herself alone about the various characters of the play she feels she is also a part. In a way, the storyline reveals the tragedy of a middle-aged teacher who assumes to be an active participant to the whole scenario of people and the company of band. She feels that she can relate herself to the surrounding, as she enjoys listening and guessing the responses of other characters but the lover couple shatters her belief when the girl giggles, "Its her fu-ur which is so funny." The theme is beautifully stated till the end of the story in third person (Mansfield 857). Characterization and setting extends the theme of loneliness, rejection, and isolation beautifully. The performance of musical band also depended on the setting. If the season was on, tunes were played without any callousness, but during out-of-season times, the performance of the band was as if â€Å"there weren’t any strangers present† (Mansfield 855). The conductor also wears â€Å"a new coat†¦flapped his arms as if a rooster about to crow.† The musicians were also full of spirit due to the new season. The narrator reveals her mind through the character of the Englishman’s wife whom her husband insists to wear gold rims covering her ears so that her glasses do not fall down, and she negates the idea, remarking, "Theyll always be sliding down my nose!" Miss Brill also wanted to do the

Define the medical model of health and describe the differences when Essay

Define the medical model of health and describe the differences when compared to the social model of health - Essay Example This health model is based on a medical scientific paradigm that emphasizes a restoration of health to a state of general well-being and the key word is recovery (Lyng, 1990:100). On the other hand, the social model of health emphasizes the prevention measures that can be made on society as a whole that will promote overall well-being in a certain population by making some changes in the lifestyles of people. In other words, the social model of health looks at the social causes of diseases and examines how the breakdown in social systems can be contributory to the outbreak and spread of diseases (Earle, 2007:55). The large-scale health projects commonly adopted by governments to eradicate certain diseases embrace this social model of health by trying to change a whole citys or even an entire countrys population. This latest concept to sweep among public health policy makers compares societal breakdowns as the primary cause of diseases within society. A good example would be social and economic inequalities which contribute to the poor health of certain segments of society such as ethnic or minority groups which do not have access to proper medical care servic es. The medical model of health is concerned mainly with the health of an individual and this is more or less in terms of physical health. This model takes a narrower view of the health of the individual in terms of physiological or biological changes as determined by a diagnosis. On the other hand, the social model of health takes an encompassing view of the health of the entire society and is a multi-disciplinary endeavour ranging from surveillance and detection of diseases in a population (epidemiology) to the promotion of public health through a provision of relevant health advice and timely health information. As such, the social model of health acquires greater significance in terms of promotion of the economic well-being of a nation as well.

Describe the mechanisms by which astrocytes control the neutronal Essay

Describe the mechanisms by which astrocytes control the neutronal environment and, using appropriate examples, discuss their importance for neuronal function in health and disease - Essay Example In this article, the role of astrocytes in maintaining the neuronal environment in the brain has been explored with reference to health and disease in human beings. Astrocytes are a type glial cells in the brain and the spinal cord which are star-shaped. They are also known as astrocytic glial cells. They serve many functions, the most important of which are nutrient supply to nervous tissue, biochemical support of endothelial cells which form the blood-brain barrier, maintenance of the balance of the extracellular ions and taking part in the process of repair and regeneration of the central nervous system following various injuries (Magistretti and Ransom, 2008). There re mainly 3 forms of astrocytes. They are fibrous astrocytes, protoplasmic astrocytes and radial astrocytes. Fibrous astrocytes are basically positioned in the white matter. They have few organelles. The cellular processes are 50-60 in number, long and unbranched (Magistretti and Ransom, 2008). When in close proximity, they physically connect the cells to the outerside of the capillary wall. The protoplasmic astrocytes are mainly found in the grey matter of the brain. In contras t to the fibrous cells, they have many organelles and have short, stubby and severely branched cellular processes. These processes are in contact with the blood vessels and also the pial surface. They also surround the neurons. The end-feet of these astrocytes cover the intraparenchymal surface completely and express glucose transporters Glu T type-1 (Magistretti and Ransom, 2008). Thus these cells predominantly function to take-up glucose. Fibrous astrocytes contain more intermediate filaments than protoplasmic astrocytes. The radial glia are mainly found in the vicinity of the ventricles. While some processes abut the piamater, other processes lie deep inside the gray mater. Some examples of radial astrocytes are Bergmann glia cells and Mueller cells of the retina.

Pharmacy Essay Example for Free

Pharmacy Essay 1) School Organizations Describe any organizations or activities at school in which you have participated, and highlight any achievements for which you were recognized or leadership positions. During school, I spent much of my time involved in outside organizations – volunteering in pharmacies, working several jobs.   I worked these jobs in order to learn more about the U.S. culture.   I am originally from Iran (born in the U.S. but raised in Iran), and while I was studying there, I served as a T. A. for a high school chemistry class.   This was a strong role for me, in order to learn about helping people, and learn more about chemistry, two important ideas I will need for pharmacy school. 2)Community Service Describe any community service related activities for which you have volunteered, and highlight any accomplishments. My most recent volunteer experience is almost my most relevant one.   From October through December, 2007, I volunteered at the Care Plus pharmacy.   This enabled me to truly help people as well as learn more about my future career.   As a volunteer in the pharmacy, I helped people to learn about various health products, improving their quality of life.   After the first couple of months in this job, I was able to continue as paid staff because of the satisfactory job that I did.   I was proud to continue serving peoples’ health needs. 3)Outside Interests Describe hobbies, recreational interests or other personally rewarding activities in which you participate, and elaborate on their importance to you. Beyond my school and work, I had many other hobbies and interests.   Since I grew up in Iran, one area of major interest to me is American culture.   To study American culture, I have taken several different jobs, including at Starbucks, Nordstrom’s, and Macy’s.   These jobs helped me to learn English better, as well as to understand Americans in general.   I also worked for Caloptima Insurance company, which allowed me to understand the American medical system better, and to continue to help people. I feel that knowing the American culture is very important, since I am still fairly new to this country.   I find the culture fascinating.   In my job as a salesperson, I was able to become a top salesperson through communication and understanding people.   I really love to work with people and help them in all situations, so this was very exciting for me. 4)Intellectual Interests Sharing intellectual interest is an important aspect of professional life. Describe a book, class, or activity that you find intellectually exciting and specify your reasons. One of my favorite intellectual activities was being a TA.   I enjoyed assisting a professor (working with a professional colleague) as well as teaching students.   It was a way for me to look at information in a new light.   This is a skill I will need as a pharmacist, when I’ll be talking to patients who do not have any medical training, and who may be worried or scared by their recent diagnosis and newly prescribed medication.   I will need to be able to explain any relevant information to them on a level they can understand.   I feel that my experience as a TA for high school students has prepared me well for this aspect of my career. 5)Other Information (Optional) You may use the space below to tell us anything else you would like us to know about you. I was born in U.S., but due to my parents’ divorce, I moved to Iran at age three to live with my grandparents.   This gives me a very unique perspective on the world and the cultures in it.   In today’s America, being culturally aware and sensitive is a huge issue.   Coming from a background that is both Iranian and American, I feel that I am unusually aware of and sensitive to multicultural people and perspectives. Also, in living with both my grandparents and later, my father (who is an important professor in Iran), I was exposed to solid family values.   My father’s work also inspired me.   I feel very fortunate to have had these experiences, and I feel that it has helped me so much in becoming who I am and in helping me pursue pharmacy.   In fact, every step of the way, my family situation has strengthened my desire to study pharmacy so that I can help other people.

Performance Management at Steel Co

Performance Management at Steel Co Contents Structuring individual performance to maximize firm’s performance Expectancy theory has three underlying concepts: Performance management system used to improve employee development and communication Effectiveness of linking performance to financial reward Bibliography Structuring individual performance to maximize firm’s performance Individual performance is determined by the following factors: Motivation, the desire to do the job Ability, capability, know how to do the job (cognitive ability, reasoning ability, physical ability) Work environment, tool materials and information to do the job The energy to perform in an organization is directly influenced by the level of motivation and the expectancy. As long as the desire to do something is present, the mount of performance output is directly proportional with the level of energy exercised. Motivation is a function of expectancy, instrumentality and valance and expectancy, is used as a tool to explain the determinants of workplace attitudes and behavior. In other words try to perform and you will succeed. Expectancy theory has three underlying concepts: 1. The Concept of valence refers to anticipated satisfaction. While value represents the actual satisfaction that a person experience from an attained outcome. Potentially a discrepancy can occur between the anticipated satisfaction from an outcome (valence) and the actual satisfaction that it provides (its value). When such disparity occurs, the reward system implemented will lead to loss of the motivational value. 2. Instrumentality represents a person’s belief about the relationship between performing an action and experiencing an outcome. The high performance is most likely to occur when both the valence and instrumentality are perceived high. It is important to understand individual’s motivational behavior by not only identifying his/hers satisfaction expected as a result of attained particular outcome, but also what actually the person thinks that he /she needs to do or not, to achieve the outcome. 3. Expectancies, representing a link between making an effort an actual performing well. It is more like motivation based on desire and effort. Expectancy should be accompanied by specific goals setting and type of performance desired in quantitative terms. Goals should be difficult enough, to where the individual motivation will be driven by the values received from a job well done. The concept of self-efficacy is based on the individual ability to complete the task if he/she tried. Self -efficacy can increase by: emphasis on past accomplishments, observation of others, verbal persuasion (appealing to individual self image) Performance management system used to improve employee development and communication (McCaffery (2004) explains that a key competent of learning and development support in managing performance is guidance given by line managers to develop the knowledge or skill of their subordinates. (McCaffery,p139 (2004) believes that ‘performance management is a cyclical process centred on learning and development-not a fixed one-off event†¦performance management does not just happen, as is often(wrongly) assumed, at an annual event set up for the purpose. Formal appraisal is but a single process. The core foundation of performance management is learning and development. (Armstrong, p246 (2009) believes that performance management has a vital role in an organisation, by ‘specifically helping people to appreciate the need for developing their performance and where and how it should take place,’ and ensuring that people can learn from their experience. Performance management can help people find specific courses on or off the job or by e-learning which will satisfy their learning need. But performance management’s most essential role is the help it gives to the development of a climate for learning- a ‘growth culture’. This process helps people avoid obstacles that can arise when guiding them through work challenges. It ensures that the workers have the resources and time that they need to learn, also that management can advice and support them and give feedback that is vital for them to learn. (Foot, Cook (2008) comment on the fact that often organizations want to develop by improving performance. They want to meet their strategic objectives, or gain high-performance standards in the organization, and they wish to increase profits for shareholders, develop their market share or provide better services for their customers to avail of. (Foot, Cook (2008) explain that in order to achieve these ideals, they need to select, recruit, motivates, develop and retain the best people for the job. (Foot, Cook, p277(2008) highlight that ‘learning and development is one of the key aspects in performance management which can help them achieve these things and it is also a key factor in managing talent.’ Individuals in an organization have the drive to improve their performance in their job, or gain new skills perhaps to get a promotion or pay increase or even move on to a more challenging and fulfilling job. (Foot,Cook(2008) believes individuals can achieve these aims with help from learning and development . Learning and development can help organizations by attracting individuals and can engage their loyalty so the organization benefits by retaining new recruits, this in turns helps the organization to optimize its current and future objectives. (Foot,Cook (2008) emphasize the fact that learning and development has gain popularity over the past years, as organizations have realized that in order to stay competitive they need to develop and utilize the knowledge of their staff as much as possible, in order to do so they need to focus their activities from training to learning. (Foot,Cook) continues, by saying, people learn in different ways, some of these ways can be planned others, unplanned. In order for learning to occur organizations have to ensure that they create suitable environments, so that workers can clearly benefit from the learning and knowledge of their workforce. (Foot,Cook, p278 (2008) reveals that ‘the concept of individualized learning implies that this occurs in all sorts of situations, not just in the more traditional, formal training opportunities.’ Learning and development include mentoring, coaching, job swapping and work shadowing which are less formal and are more learner centered approaches to learning. (Wilton, p183 (2013) comments how ‘in human resource development, it is important to highlight the role of learning and development in performance management and in fostering a culture of continuous improvement.’ In a firm, (Wilton(2013) explains that employee development is considered a key mechanism through which organizational performance can be improved. Learning and development provides substantial linkages within the cycle, forming part of both the evaluation or review phrase and the planning phase. (Wilton (2013) emphasizes the fact that learning and development plays a vital role in relation to remedial action to resolve performance problems. Effectiveness of linking performance to financial reward In many organizations the HR function and the business will attempt to align individual performance to a bell curve of anticipated or actual required performance ratings. This approach is often positioned as being necessary to reward the highest individual performers appropriately, or to justify how the actual business and individual employee performance compares to other high performing organizations (or both). However, when attempting to manage performance distribution across the organization the HR function is often faced with some pretty difficult questions and issues, such as, How can we have so many high performance ratings when we arent achieving our organizational performance goals? Why are we paying our best performers pretty much the same as our worst performers? Are we rewarding the right people? What is actually happening in many organizations is that they believe they are paying for one thing (performance) when in actual fact they are paying for something else. For example, reward for promotion often exceeds annual pay increases for performance within any given level, no matter how much the employee has contributed. Therefore, employees have a much greater incentive to try to get promoted than to stay put and do an outstanding job. This issue can be exacerbated by the use of broad band’s (grades) and salary ranges; all too often, organizations implement a new approach to pay without considering how to communicate to their employees the principles of progression within a salary range. If we take another example, you may work in an organization which is results-oriented, and management is only interested in financial measures such as profit or revenue. Financial rewards are probably used as the major motivator for staff, as we have seen within the financial services sector. However, this approach may not be the right one for employees who are not motivated by financial reward and are perhaps already highly committed to the goals of the organization. In this situation, non-monetary rewards may be the way to go. For smaller organizations where promotion opportunities are limited, the opportunities for employees to reap financial rewards for moving up and for performing well are also limited. Linking performance and reward effectively relies on a good understanding of your organizational context, and the mix of employee motivating factors.   Bibliography Armstrong, Michael.(2009) Armstrong’s Handbook of Performance Management. religious studies :: essays research papers

AO1- What is meant by the term, â€Å"rite of passage†? Choose one Christian denomination. Describe the main rites of passage in that denomination.   Ã‚  Ã‚  Ã‚  Ã‚  I am going to describe the Roman Catholic churches main rites of passage. There are four important rites, they are; baptism, confirmation, marriage and funerals. A rite is a religious ceremony. If the rite marks a certain stage of someone’s life it is called a rite of passage. Christians believe god gives them powers to do his will, this is called god’s grace.   Ã‚  Ã‚  Ã‚  Ã‚  The first rite I will describe is baptism. When a person is baptised it is believed that it is their welcome into the Christian church. Holy water is either put onto the person’s forehead or they are totally covered in water. This is a rite of passage because it is believed to be a very special as god is accepting them into the church. Infant baptisms in the Roman Catholic church take place during mass so the whole congregation of the church can welcome the child into the Christian faith. The priest takes the service. Three promises must be made but as the child is too young to say them parents or godparents say them on the child’s behalf. The promises are:  ·Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  To turn to Christ  ·Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  To repent sin  ·Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  To renounce evil They also agree to raise the child in a Christian house and faith and say that they believe in the Trinity. The sign of a cross is made on the child’s forehead by the priest while he says; â€Å"I sign you with the cross, the sign of Christ. Do not be ashamed to confess the faith of Christ crucified.† As the priest says the child’s name and; â€Å"I baptise you in the name of the Father, and of the Son and of the Holy Spirit†, he pours water onto the child’s forehead. A lighted candle is usually given to the parents as a sign and reminder that the child is now in the light of god, and not the darkness of sin. After this ceremony the child is part of the Christian family. The child is anointed with oil called chrism, it is to show the child has important work to do in god’s service. Also a white garment is worn to show the light of Christ. The water is a sign of purifying the child.   Ã‚  Ã‚  Ã‚  Ã‚   The second of the rites is confirmation. It is when someone confirms their belief in god and Christ and when someone who has been baptised is old enough to make the promises made for them at their baptism themselves.

The Eye Of The World :: essays research papers

Setting:The setting of this story is a fantasy world, with your basic medieval background. It has magic, swordplay, large-scale armies on grassy plains, and a touch of technology. There is the ‘big evil power’ off to the north somewhere that will apparently figure into the series five books down the road, and various evil creatures that battle the good guys. The ‘big good power’ can’t interfere, so it lets the meager humans handle things. Men and women are each clearly defined, with each sex even having different kinds of magic. The guys go insane from theirs, and the women use their power to hunt down those men. Character:There are countless characters in this story, ranging from one-shot guards who die in obscurity, to the Really Big Monsters. All of them are chock full of personality and character, no matter their roles and life span. The main characters, those that live long enough to be considered such, are as follows. There is Rand, a youth from a village who discovers he has strange powers that will one day drive him insane. Egwene, from the same village, also has this power, but apparently the women don’t go insane, and she will have to kill Rand. Naturally, there is a relationship between the two, one that will be put to the test. There are also Moiraine, a sort of elder witch, Lan, the big brawny swordsman, and a whole slew of others that split up and go their separate ways in other books in the series. Plot:The plot follows several different people at once, jumping back and forth when you least expect it. The basic plot is this; an evil entity, namely the antithesis of all that is good and pure, is trying to destroy the world and remake it in his own image. The Creator, a sort of god, has bound him away for all eternity, but a hole is bored into his prison. The Creator uses several young people as his unwitting avatars in the struggle between good and evil. They run away from hideous monsters that chase them through this world, such as a trolloc, a sort of man-beast, and various others. They make their beleaguered way north, until a path is found to a source of ultimate power. In the end, this power is used for good, and the Evil darkness is bound away. Until the next book in the series†¦ It seems like your basic ‘Light against Dark, Good vs.

Internet Plagiarism :: Online Plagiarism

Internet Plagiarism "I am an Evil House of Cheat subscriber. Ever since I've had access to your service my grade in English 102 has gone from an 'F' to a 'B.' I use the cheathouse for other classes too, like Philosophy and history. Thank you for saving my butt— A happy anonymous user." Testimonials trumpet across Evil House of Cheat's Web site (cheathouse.com), gushing praise for this racket, which lets online clients download their pick of more than 1000 previously written term papers for free. "Super Users" who ante up $19.95 a year get full clearance to an additional 1000-plus essays locked into the site's database. Evil House of Cheat is among the 100 or more Web sites currently found on the Internet that allow students to download archived or custom-written papers. Some students cut and paste portions of these to create an entirely new document. Term paper mills run somewhat like co-ops and typically solicit essays from students, who post their work, bibliographies and citations included, at no charge. Commercial sites, on the other hand, jettison any association with their term paper mill country cousins by calling themselves "research companies" and often supplement student submissions by hiring professional writers to pen tailor-made term papers for clients. Price tags for these "reference materials" can range from about $27.50 to $1000 an essay. As clever as it may sound, plagiarizing via the Internet is a fresh riff on the traditional practice of fraternities and sororities offering members term paper files to sift through by subject or instructor. But now, teachers who may have previously cross-examined suspicious students by asking them to orally dissect their term paper's argument are now funneling college and university funds toward Internet-based antiplagiarism services and software. This means instructors and students are wielding the same weapon, the World Wide Web, in this cyber brouhaha. For teachers, a grudging reliance on technology coexists with the reality that some students are genuinely unaware that information must be attributed when it is culled from a clearinghouse like the Internet— just as when it is taken from a newspaper or an encyclopedia. The boundaries between research and cheating are becoming increasingly ambiguous. "One time I was teaching a summer version of my class and a student turned in bits and pieces of information on Captain Ahab that she had downloaded off, I kid you not, schoolsucks.com [a term paper mill].

What Happened to Kmart

Case Study – What Happened to Kmart? 1. Evaluate Kmart using the value chain and competitive forces models. What was Kmart's business model and business strategy? Kmart has numerous problems with its value chain. This is evident from the suppliers sending items that the suppliers want to sell, shelves remaining unstocked, the â€Å"hand shifting† reordering process for popular items, products being allocated by central planners and not based on individual store demand, excess inventory stored in 15,000 truck-trailers behind its stores, shrinkage, and having to choose to either ship toothpaste or Christmas trees.Since its entrance as the first discount store in the 1960s, Kmart has not been able to ward off new entrants into the discount chain business. The new entrants, such as Wal-Mart and Target, have come on strong and surpassed Kmart. Kmart's suppliers seem to be calling the shots with the retailer, since they are promoting the items that they can sell and not helpi ng Kmart address its mounting problems. Kmart's customers are voting with their pocketbooks and shopping at its competitors' stores.Kmart uses a promotions-drive business model. The company uses advertising circulars to promote its â€Å"blue-light† specials. 2. What was the relationship of information systems to Kmart's business processes and business strategy? How well did its systems support its strategy? Kmart's information systems and its business processes and business strategy were not in alignment. As an example, the information systems could collect data, but the data were not available for analysis and decision-making purposes. As the case mentions, forecasting decisions were based on management's judgment, not on the data. Kmart's systems did not support its strategy. One of the problems mentioned in the case is that its supply chain management system could not easily accommodate the sharp increases and decreases in demand. The distribution center's outdated technol ogy led to supplies sitting on pallets for 24 hours until they were recorded in the central tracking system. When reordering popular products, the employees would hand sift through previous purchasing receipts. . What management, organization, and technology factors contributed to Kmart's problems? From the case, it appears that Kmart management is inconsistent with its implementation of the company's strategy. Management is unable to use data to forecast demand; it has lost sight of its core competencies, and is unable to change Kmart's image. Although management wanted to restructure its supply chain, it continued to expand its product offerings, as opposed to focusing on the fastest selling items. Mr.Conaway's plan to restructure Kmart has obviously not worked out. Although Mr. Conaway wanted the local stores to make their own stocking decisions, the stocking decisions were still being made by the central planners. When the new system was installed, Mr. Buzek made the comment tha t â€Å"the information would be useless because management just didn't believe in the system. † Although the company uses a promotions-driven strategy, the company reduced its advertising circulars. As the case points out, no other alternative for achieving the strategy was provided.Although Kmart wanted to reinvent its supply chain, management was unwilling to unify the distribution system's two computers because the project was too expensive. From an organizational perspective, the suppliers, central planners, business processes, individual stores, warehouses, and distribution center have definite communication problems and are not sharing data as efficiently as possible. One could argue that very little data sharing is going on. Central planners are making the stocking decisions for the individual stores, but what needs to be stocked at each store is not being effectively communicated. From a technology perspective, outdated technology and incompatible systems were in plac e. The new i2 project did not succeed for a variety of reasons, including the need for more hardware, the inability of the project to connect the point-of-sale systems and inventory systems to the distribution systems, and not being robust enough to handle a large number of SKUs. 4. How important was supply chain management in contributing to Kmart's problems? Evaluate Conaway's decision to use i2 software to improve Kmart's supply chain management.Supply chain management was very important to Kmart. Kmart has been unable to successfully manage its inbound logistics, operations, sales and marketing, service, and outbound logistics. Unfortunately, the company's inability to effectively manage its supply chain led to ineffective advertising, lots of items being overstocked, popular items being understocked, a large product offering, poor communication with suppliers and its business units, items sitting on pallets waiting to be entered into the central tracking system, and shipping pr oblems. The goals for the i2 project were commendable, since the project was supposed to improve Kmart's sales forecasting, inventory sourcing, logistics, and reporting. The project was supposed to facilitate micromarketing, supplier product tracking, order execution, shipment scheduling, and delivery tracking. It is interesting that Mr. Conaway chose i2 Technologies for the new supply chain management project, since i2 Technologies had â€Å"only recent and limited experience in the retail sector. The decision to use i2 Technologies was not a good decision, since the system was not designed to work with the large number of SKUs, Kmart (according to some) wrote off and abandoned some of its i2 software, the project fell behind schedule, and the inability to connect the point-of-sale systems and inventory systems to the distribution systems. 5. Were those blaming software for the collapse of Kmart correct? Explain your answer. Actually, there is enough blame to go around. 2 Technolog ies did a very poor job analyzing and designing the system for Kmart. It also appears that Kmart's management did not get behind the project and was also unwilling to transform its core business processes. 6. It has been said that â€Å"Wal-Mart uses their IT strategically, and they fully integrate it into their operating model. † Does this statement apply to Kmart? Explain your response. This statement does not apply to Kmart.Kmart is using an outdated business model and has been unwilling to change its model. Its unwillingness to change is one of the reasons why Wal-Mart and Target have been able to successfully compete against Kmart and why Kmart is in bankruptcy. 7. List the problems Conaway faced when he took over Kmart, and then describe the short- and long-range policies you would have followed had you been in his place. When Mr. Conaway took over Kmart, he faced several problems, including stiff competition from Wal-Mart and Target. The company was using an outdated bu siness model, spending more money than the competition to get its goods into its stores, its information systems were collecting data but not using it effectively, it had significant problems with its entire value chain, it had a frumpy reputation, its shelves were often empty, it offered a wide range of products, it provided poor customer service, and it did not care about the competition. Students will provide a variety of short- and long-range policy recommendations.
